ARTICLE 2 – SUBJECT

The subject of this agreement concerns the sale and delivery of the product(s) ordered electronically by the BUYER from the SELLER’s website “www.asafatelier.com“, in accordance with the provisions of the Consumer Protection Law No. 4077 and the Regulation on the Implementation Principles and Procedures of Distance Contracts, determining the rights and obligations of the parties.

ARTICLE 3 – PRODUCT SUBJECT TO THE CONTRACT

The type and kind, quantity, and sales price of the products are as specified on the website.

ARTICLE 4 – GENERAL PROVISIONS

4.1 – The BUYER declares that they have read and are informed about the basic characteristics, sales price, payment method, and delivery information of the product(s) subject to the contract on the https://asafatelier.com/ website and provided the necessary confirmation electronically.

4.2 – The product subject to the contract will be delivered to the BUYER or the person/organization at the address indicated within the period specified in the preliminary information on the website, without exceeding the legal 30-day period, depending on the distance of the BUYER’s residence.

4.3 – If the product subject to the contract is to be delivered to a person/organization other than the BUYER, the SELLER cannot be held responsible if the person/organization does not accept the delivery.

4.4 – The SELLER is responsible for delivering the contract product in a complete, undamaged manner, in accordance with the qualities specified in the order, and with warranty documents and instruction manuals if applicable.

4.5 – Delivery of the product subject to the contract is contingent upon the SELLER receiving a signed copy of this agreement and the payment being made by the payment method preferred by the BUYER. If the product price is not paid or cancelled in bank records for any reason, the SELLER is released from the obligation to deliver the product.

4.6 – In the event that the credit card of the BUYER is used unjustly or illegally by unauthorized persons not due to the fault of the BUYER after the delivery of the product, and the bank or financial institution does not pay the product price to the SELLER, the BUYER must return the product to the SELLER within 3 days, provided that it has been delivered to them. In this case, the shipping costs for material products are borne by the BUYER.

4.7 – If the SELLER cannot deliver the product subject to the contract within the period due to force majeure or extraordinary circumstances such as adverse weather conditions, interruption of transportation, etc., the SELLER is obliged to inform the BUYER. In this case, the BUYER can choose to cancel the order, replace the product subject to the contract with an equivalent, if any, and/or postpone the delivery until the barrier is removed. If the BUYER cancels the order, the amount paid will be refunded in cash and in full within 15 days.

4.8 – Persons under the age of 18 cannot shop from the SELLER.

4.9 – The SELLER is not responsible for pricing errors due to typesetting and system errors.

4.10 – The SELLER has the right to change or cancel the content, scope, and features of all products sold on its website.

4.11 – Upon the realization of the order, the BUYER is deemed to have accepted all terms of this contract.

ARTICLE 5 – RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw within 7 days from the delivery of the product(s) subject to the contract to them or the person/organization at the address indicated, within the rules specified in Article 6 of this contract. To exercise the right of withdrawal, it is mandatory to notify the SELLER by fax, e-mail, or phone within this period and that the product has not been used in accordance with the provisions of Article 6. In case of using this right, it is obligatory to return the original invoice and the copy of the cargo delivery report indicating that the product delivered to the third party or the BUYER was sent to the SELLER. Following the receipt of these documents, the product price will be refunded to the BUYER within 15 days for material products. The shipping cost for the returned product due to the right of withdrawal is covered by the BUYER. The return process will not be completed without presenting the original invoice.

ARTICLE 6 – AUTHORIZED COURT

In the application of this contract, Consumer Arbitration Committees up to the value announced by the Ministry of Industry and Trade, and Consumer Courts in the SELLER’s place of residence are authorized.

To complete your return, we require a receipt or proof of purchase.

Please do not send your purchase back to the manufacturer.

There are certain situations where only partial refunds are granted:

  • Book with obvious signs of use
  • CD, DVD, VHS tape, software, video game, cassette tape, or vinyl record that has been opened.
  • Any item not in its original condition, is damaged or missing parts for reasons not due to our error.
  • Any item that is returned more than 30 days after delivery

Refunds

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds

If you haven’t received a refund yet, first check your bank account again.

Then contact your credit card company, it may take some time before your refund is officially posted.

Sale items

Only regular priced items may be refunded. Sale items cannot be refunded.

Exchanges

We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at {email address} and send your item to: {physical address}.

Gifts

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and they will find out about your return.

Shipping returns

To return your product, you should mail your product to: {physical address}.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you may vary.

If you are returning more expensive items, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
